Terms & Conditions

Last updated: October 21, 2026

Welcome to Spectrum Collective. We are committed to creating an inclusive, accessible, respectful and community-oriented environment for movement, fitness, wellness and connection.

These Terms and Conditions govern your use of the Spectrum Collective website at spectrumcollective.ca, including its content, contact forms, newsletter signup and online booking features. They also describe general terms applicable to classes, training, studio use, workshops and services offered through Spectrum Collective.

Please read these Terms and Conditions carefully before using the website or booking a service. By accessing or using the website, or booking or participating in a service where these terms are presented as applicable, you agree to the relevant provisions below. If you do not agree, please do not use the website or book services through it.

These terms do not replace any separate consent form, waiver, rental agreement, practitioner agreement or service-specific policy that applies to you. Where a separate written agreement governs a particular service or rental, that agreement will govern the specific matters it addresses, subject to applicable law.

1. Business Information and Contact
Spectrum Collective is operated as a sole proprietorship in Ontario, Canada.
Business address:
238 Gerrard Street East, Unit 201
Toronto, Ontario, Canada

2. Website Use
You agree to use the Spectrum Collective website lawfully and respectfully.

You must not:

  • Use the website for unlawful, fraudulent, abusive or misleading purposes.

  • Attempt to interfere with the website's security, functionality or operation.

  • Access systems, accounts or information without authorization.

  • Introduce malicious code or attempt to disrupt website services.

  • Copy, reproduce, distribute or commercially exploit website content except as permitted by law or with our prior written permission.

  • Submit false, misleading, threatening, discriminatory or unlawful material through our website or contact channels.

We may take reasonable steps to protect the website and our community from misuse, including restricting access where appropriate.

We aim to keep the website accurate and accessible, but we cannot guarantee that it will always be available, uninterrupted or error-free. Website content may be updated, corrected or removed as our services evolve.

Nothing in this section limits rights or remedies available under applicable law.

3. Services and Bookings
Spectrum Collective facilitates or provides a range of activities and services, which may include:

  • Group fitness classes and personal training.

  • Open gym access.

  • Workshops and community events.

  • Studio rentals.

  • Massage, bodywork and other wellness services.

  • Services offered by independent practitioners.

Service descriptions, availability, prices, booking arrangements and other details may vary by activity and provider. Current information should be reviewed before booking.

A booking is subject to availability and the applicable booking process. Please ensure that your booking details are accurate and that you understand the service, price, location, timing and relevant requirements before confirming.

Spectrum Collective may reasonably modify, reschedule or cancel a service when necessary, including because of instructor availability, safety concerns, facility issues or circumstances beyond our reasonable control. Where appropriate, affected clients will be notified and advised of any applicable rescheduling or refund arrangements, subject to applicable law and the terms of the relevant service.

4. Payments, Cancellations and Refunds
Payment arrangements and cancellation policies may differ between Spectrum Collective-operated services and services provided by independent practitioners.

Before making a booking, you are responsible for reviewing the applicable price, payment terms, cancellation policy and refund conditions.
If a cancellation or refund policy is not clearly stated, please contact the relevant practitioner or service provider before booking to confirm the applicable arrangements.

Unless otherwise specified in the applicable service terms:

  • Client cancellations, late cancellations and missed appointments are governed by the policy applicable to the booked service.

  • Rescheduling and refund requests should be directed to the relevant service provider.

  • Where a practitioner manages the service and its payments, that practitioner is responsible for handling applicable refund requests.

  • Where Spectrum Collective directly operates a service, refund and cancellation requests should be directed to Spectrum Collective through the published contact details.

We do not promise that every cancellation will qualify for a refund. However, all cancellation, payment and refund terms remain subject to applicable consumer protection laws and any non-waivable legal rights.

Spectrum Collective does not currently offer memberships, recurring membership plans or prepaid membership packages as a general offering. If these or other prepaid products are introduced in the future, their terms will be communicated as applicable.

5. Fitness, Movement and Wellness Risks
Participation in physical activity, fitness training, open gym sessions, workshops, bodywork and other wellness services may involve inherent risks. Depending on the activity, these may include muscle soreness, strains, falls, injuries, aggravation of existing conditions or other adverse effects.

By participating, you acknowledge that you are responsible for making informed decisions about your participation and for communicating relevant limitations, injuries, health concerns or accommodation needs to the appropriate instructor or practitioner.

You should seek advice from a qualified healthcare professional where appropriate before beginning a new physical activity or wellness service, particularly if you have concerns about whether it is suitable for you.

Services offered through Spectrum Collective are not a substitute for medical diagnosis or treatment where medical care is required. The nature and scope of advice provided will depend on the service and the qualifications and professional scope of the provider.

You agree to follow reasonable safety instructions, use equipment appropriately and stop an activity if you believe it is unsafe for you. Please promptly report hazards, injuries or safety concerns to the appropriate person.

Nothing in these Terms and Conditions excludes or limits liability or other rights where such exclusion or limitation is prohibited by law.

6. Health Information, Consent and Waivers
Some services may require a separate consent form, health questionnaire, waiver or other documentation before participation.

Separate consent forms currently apply to certain services, including massage, fascial stretch therapy and acupuncture. Additional forms or requirements may apply as other services and procedures are developed.

You are responsible for reviewing and completing applicable documentation before participating. Parents or legal guardians may need to provide consent for minors, depending on the service and applicable law.

A consent form or waiver applies according to its own terms. These Terms and Conditions do not replace those documents, and signing a form does not remove any legal obligations that cannot lawfully be waived.

7. Independent Practitioners
Spectrum Collective works with a combination of directly operated services and independent practitioners.

Where a service is provided by an independent practitioner, that practitioner is responsible for their own service delivery and applicable professional obligations, which may include:

  • Qualifications, training and professional competence.

  • Licensing, registration or other regulatory requirements where applicable.

  • Professional insurance where required or appropriate.

  • Client intake, informed consent and service-specific documentation.

  • Scheduling, service descriptions, fees and cancellation policies.

  • Handling payments, refunds and complaints relating to their services, where applicable.

  • Maintaining appropriate professional boundaries and confidentiality.

Independent practitioners may operate their own businesses and may have their own service agreements, policies and contact arrangements.
Unless expressly stated otherwise, an independent practitioner is not an employee, partner, agent or joint venturer of Spectrum Collective merely because they provide services at, through or in association with the studio.

The nature of the relationship and the responsibilities of each party depend on the actual arrangements in place. Nothing in these terms overrides applicable law or an express written agreement.

Please direct questions about an independent practitioner's service, qualifications, booking, payment or refund policy to that practitioner. You may also contact Spectrum Collective if you need assistance identifying the appropriate contact.

8. Studio Rentals and Facility Use
Studio rentals may be governed by a separate written agreement or individual arrangement between Spectrum Collective and the renter.
The applicable rental agreement or arrangement governs the specific rental terms, which may include fees, deposits, cancellation, permitted use, access times, equipment, cleaning, damage and other responsibilities.

Renters must:

  • Use the premises only for authorized purposes.

  • Follow applicable safety instructions and facility rules.

  • Treat the premises, furnishings and equipment with care.

  • Leave the space in the condition required by the applicable rental arrangement.

  • Respect other studio users and the surrounding community.

  • Ensure that their activities comply with applicable laws and relevant professional requirements.

  • Obtain any permissions, insurance or authorizations required for their activities.

Renters are responsible for damage, loss or additional costs to the extent provided in their applicable agreement and permitted by law.

No renter may transfer access, sublet the space or allow unauthorized use unless permitted by the relevant agreement.

Where a separate rental agreement conflicts with these general terms on a rental-specific matter, the rental agreement will govern that matter to the extent permitted by law. General website and community rules continue to apply where relevant.

9. Minors and Guardian Consent
Some Spectrum Collective services may be available to minors, subject to the requirements of the particular activity or practitioner.

Age restrictions, parental or guardian consent, supervision requirements and other safeguards may differ by service.

Where a parent or legal guardian is required to provide consent or supervision, they are responsible for ensuring that the applicable requirements are met. Additional documentation may be required before participation.

Parents and guardians should review the relevant service description, safety requirements and consent documentation before booking for a minor.
Spectrum Collective reserves the right to decline or postpone participation where age, consent, supervision or safety requirements have not been satisfied, subject to applicable law.

10. Community Standards and Conduct
Spectrum Collective is committed to an inclusive, respectful and accessible environment.

All clients, practitioners, renters, visitors and other community members are expected to act respectfully and help maintain a safe space for everyone.
The following standards apply when using the studio, participating in services or interacting with the Spectrum Collective community.

10.1 Respect and anti-harassment
Harassment, intimidation, threats, violence, discriminatory conduct, hate speech and abusive behaviour are not acceptable.
Everyone is expected to communicate respectfully and to respect differences in identity, ability, background, communication style and personal experience.

10.2 Consent and physical boundaries
Consent must be obtained before physical contact, except where a different legal or emergency context applies.

Clients may ask questions about proposed contact, communicate their boundaries and withdraw consent where applicable. Practitioners and instructors are expected to respect consent and professional boundaries.

Participation in a class or service does not constitute blanket consent to physical contact.

10.3 Accessibility and accommodation
We aim to create an environment that welcomes people with different access needs and sensory preferences.

Please communicate accommodation requests or access concerns in advance where possible so that we can discuss reasonable arrangements. The availability of a particular accommodation may depend on the circumstances, the facility and the nature of the service.

We will consider requests in good faith and in accordance with applicable legal obligations.

10.4 Scent and sensory considerations
Please be mindful of fragrances, scented products, noise and other sensory factors that may affect other community members.
Where requested or appropriate, participants should follow service-specific instructions designed to support a more comfortable and accessible environment.

10.5 Equipment and facility safety
Use equipment only for its intended purpose and follow reasonable instructions from instructors or authorized personnel.

Do not use equipment or participate in activities in a manner that creates an unreasonable risk to yourself or others. Report damaged equipment, hazards or unsafe conditions promptly.

10.6 Confidentiality and respect for others
Respect the privacy and personal boundaries of other clients, practitioners and community members.

Do not share another person's private information, personal disclosures or identifying details without appropriate permission, except where disclosure is authorized or required by law.

This expectation does not prevent anyone from reporting misconduct, seeking support, making a complaint or exercising their legal rights.

10.7 Photography and recording
Photography, video recording, audio recording and livestreaming are not permitted where affected individuals or Spectrum Collective have not given the required permission.

You must not record another person during a class, appointment, workshop or other activity without appropriate consent. Additional restrictions may apply to confidential, private or professionally sensitive services.

Permission to attend a service does not constitute permission to photograph or record other participants.

10.8 Enforcement
Concerns about conduct will be addressed case by case, taking into account the nature and seriousness of the behaviour, safety, the impact on others and the circumstances.

Responses may include a conversation, warning, request to stop an activity, removal from a session, restriction or suspension of access, or termination of participation where appropriate.

Serious misconduct or an immediate safety concern may justify immediate action without a prior warning.

Any decision regarding refunds or fees following a conduct-related incident will be considered in light of the applicable service or rental terms and relevant law.

Nothing in this section prevents Spectrum Collective from taking reasonable steps to protect the safety, dignity and rights of community members.

11. Privacy and Personal Information

The website or its service providers may also collect certain technical information through cookies or similar technologies.

Personal information may be used for purposes such as:

  • Responding to inquiries.

  • Managing bookings and related communications.

  • Delivering requested services.

  • Administering newsletter subscriptions.

  • Maintaining website security and functionality.

  • Understanding and improving website performance, where applicable.

  • Meeting legal or regulatory obligations.

Information may be processed or stored by Wix and other service providers used to operate the website, subject to the applicable arrangements and privacy requirements.

We will handle personal information in accordance with applicable privacy laws. We will not represent that information is confidential without exception where disclosure is required or permitted by law.
Please click here to visit our Privacy Policy.

Please do not submit sensitive health information through a general website contact form unless the relevant process specifically requests it and is appropriate for that information.

12. Newsletter and Email Communications
You may choose to subscribe to the Spectrum Collective newsletter or provide your email address through a website form.

Newsletter subscriptions are voluntary. You may unsubscribe at any time using the unsubscribe link provided in a marketing email or by contacting bookings@spectrumcollective.ca.

Unsubscribing from marketing communications does not necessarily stop essential communications relating to a booking, service, transaction or other existing arrangement.

We will handle email addresses and subscription preferences in accordance with applicable privacy and anti-spam requirements.

13. Website Submissions and Communications
When you submit information through our website or communicate with Spectrum Collective, you are responsible for ensuring that your submission is lawful, accurate to the best of your knowledge and respectful of others' rights.

Do not submit material that is unlawful, threatening, harassing, discriminatory, defamatory or infringing of another person's intellectual property or privacy rights.

Information submitted through a contact form or email may be used to respond to your inquiry and manage the matter concerned. We will not treat a general submission as permission to publish your personal information or use your content for unrelated promotional purposes.

If you provide suggestions, comments or feedback about our services, we may consider them for operational improvements. Any use of identifiable personal information or publication of your material will remain subject to applicable privacy, confidentiality and intellectual-property obligations.

Please understand that ordinary email and website forms may not be appropriate for urgent emergencies or highly sensitive information.

14. Intellectual Property and Content Protection
Unless otherwise indicated, the Spectrum Collective website and its original content are owned by Spectrum Collective or used with permission.

Protected content may include:

  • Website text, photographs, graphics and artwork.

  • Original class descriptions and educational materials.

  • Training materials, written resources and videos.

  • Original workshop content and other materials made available through Spectrum Collective.

You may view the website and use its content for personal, non-commercial informational purposes.

Without prior written permission or another lawful basis, you must not reproduce, republish, distribute, sell, modify, publicly display or commercially exploit protected content.

Participation in a class, workshop or training session does not grant ownership of the instructor's or provider's original materials or permission to reproduce or teach them commercially.

Nothing in these terms restricts rights that cannot lawfully be restricted, including applicable exceptions under intellectual-property law.
If you believe content on the website infringes your rights, please contact bookings@spectrumcollective.ca with details of the material and your concern.

15. Third-Party Websites and Services
The website may contain links to third-party websites, booking services, payment services, practitioner pages or other external resources.

Third-party services may operate under their own terms, privacy policies and procedures. Spectrum Collective does not control every aspect of those services and is not responsible for their content, availability or privacy practices except to the extent required by law.

A link to an external service does not necessarily constitute an endorsement of every statement, product or service offered there.
Please review the applicable third-party terms before using those services or providing information to them.

16. Limitation of Liability
To the fullest extent permitted by applicable law, Spectrum Collective is not responsible for losses arising from circumstances beyond its reasonable control, misuse of the website, unauthorized use of accounts or equipment, or the acts or omissions of third parties, except where responsibility cannot lawfully be excluded.

Responsibility for a particular service depends on who provides it, the applicable agreements, the circumstances and applicable law.
Nothing in these Terms and Conditions:

  • Excludes or limits liability where an exclusion or limitation is prohibited by law.

  • Removes consumer rights or remedies that cannot lawfully be waived.

  • Automatically transfers an independent practitioner's professional responsibilities to Spectrum Collective, or vice versa.

  • Replaces a separate consent form, waiver or written agreement that applies to a service.

No general disclaimer should be interpreted as a blanket waiver of rights relating to negligence, personal injury, consumer protection or other matters where such a waiver is not legally effective.

17. Changes to Services and Terms
Spectrum Collective may update website content, services, operating procedures and these Terms and Conditions as the business evolves.

The current version of these terms will be made available on the website with an effective date or last-updated date.

Where a change materially affects an existing contractual arrangement or requires notice or consent under applicable law, we will provide the notice or obtain the consent required.

Changes to these website terms do not automatically amend a separate signed rental agreement, consent form or other contract. Any such change must be handled in accordance with the applicable agreement and law.

Please review the terms periodically to remain informed of the current website conditions.

18. Governing Law and Disputes
These Terms and Conditions are governed by the laws of Ontario and the applicable federal laws of Canada.

If a concern arises, we encourage you to contact Spectrum Collective at bookings@spectrumcollective.ca so that the issue can be discussed and, where appropriate, resolved informally.

Nothing in this section prevents you from seeking assistance from a regulatory authority, exercising a statutory right, filing a complaint or pursuing a legal
remedy available to you.

Any dispute will be handled in accordance with applicable law, including any mandatory consumer protection requirements.

19. Severability and Interpretation
If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision will be interpreted or limited to the extent necessary, where legally possible. The remaining provisions will continue to apply.

A failure to enforce a provision on one occasion does not necessarily waive the right to enforce it later.

Headings are included for convenience and do not change the meaning of the terms.

If these terms conflict with a mandatory legal requirement, the legal requirement prevails.
